1. Definitions
"Company," "We," "Our," or "Us" refers to 803 Kustomz LLC and Container Worx LLC.
"Customer," "You," or "Your" refers to the individual or entity accessing our website and purchasing our products or services.
"Products" refers to the shipping containers, custom container homes, modular structures, and any related fabrication or modification services provided by the Company.
2. Products and Services
Custom Fabrication: We specialize in the sale and modification of container homes and modular structures. All custom fabrication is built to the specifications agreed upon in your final, signed build contract or quote.
Representations: We make every effort to display as accurately as possible the colors, features, specifications, and details of the Products available on the Site. However, we do not guarantee that the colors, features, specifications, and details of the Products will be accurate, complete, reliable, current, or free of other errors, and your electronic display may not accurately reflect the actual colors and details of the Products.
3. Orders, Pricing, and Payments
Quotes and Invoices: Prices for custom builds and modifications will be provided via an official quote. Quotes are valid for all orders placed days from the date of issue.
Deposits: Custom container homes and fabrication projects require a non-refundable deposit of the full amount before work commences, unless otherwise stated in your build contract.
Payment Terms: Full payment is required prior to the release, shipping, or delivery of any Product. We accept; Wire Transfers, ACH, major credit cards, apple pay and/or zelle pay as modes of payment.
Taxes: All prices are exclusive of applicable federal, state, or local taxes unless otherwise explicitly stated. The Customer is responsible for all applicable taxes.
4. Shipping, Delivery, and Site Preparation
Freight and Delivery: We coordinate freight logistics for the delivery of modular structures. Delivery dates are estimates only and are not guaranteed. We are not liable for any delays in manufacturing or delivery.
Site Readiness: It is the Customer's sole responsibility to ensure that the delivery site is accessible, leveled, and prepared to receive the container home or structure. We are not responsible for delivery failures due to poor site access, soft ground, or overhead obstructions.
Risk of Loss: The risk of loss and title for the Products pass to you upon our delivery to the carrier or upon delivery to your specified location, depending on the agreed-upon freight terms.
5. Returns and Refunds
Custom Builds: Due to the highly specialized nature of custom container homes and fabrication modifications, all sales on custom orders are final. We do not accept returns or offer refunds on modified containers or custom modular structures once the build process has begun.
Standard Products: Standard, unmodified and modified containers may be returned within 45 calendar days of delivery, subject to a 20% restocking fee and return shipping costs covered by the Customer. Also a refund processing time of about 10 business days.
6. Warranties and Disclaimers
Limited Warranty: We warrant that our custom fabrication work will be free from major defects in workmanship for a period of 1 year from the date of delivery. This warranty does not cover normal wear and tear, cosmetic rust, or damage caused by improper site preparation, extreme weather, or unauthorized modifications.
As-Is Condition: Unless expressly stated otherwise, used shipping containers are sold in "as-is" condition.
Disclaimer: TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
7. Limitation of Liability
In no event shall 803 Kustomz LLC Container Workx LLC, nor any of its officers, directors, and employees, be liable to you for anything arising out of or in any way connected with your use of this website or our products, whether such liability is under contract, tort, or otherwise. We shall not be liable for any indirect, consequential, or special liability arising out of or in any way related to your use of this website or the purchase of our container homes.
8. Governing Law and Jurisdiction
These Terms will be governed by and interpreted in accordance with the laws of the State of South Carolina, and you submit to the non-exclusive jurisdiction of the state and federal courts located in SC for the resolution of any disputes.
